As most of you are aware, the implementation of the Agency Workers Regulations is imminent.

The main purpose of introducing the AWR is to provide agency workers protection against exploitation and this involves both the agency & the end user (hirer) working together to ensure that basic employment rights indicated by the AWR are met.

From October 1st 2011 agencies and hirers will have to adhere to these new regulations which come under two main categories, Day 1 Rights and Post Qualification Rights.

From day 1 agency employees will be entitled to basic employment rights and conditions, however after working for the same hirer for a period of 12 weeks in a similar role, the entitlement will include additional factors relating to hours worked, breaks, bonuses and annual leave.

The AWR is a complex directive which still remains somewhat ambiguous in some areas (i.e. who is in scope), therefore we can only pre-empt the extent of its impact on the recruitment industry.
